Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you and Nexa Digital LTDA (CNPJ 57.542.168/0001-46) (“The Lost Prayer”, “we”, “us” or “our”) governing your access to and use of the The Lost Prayermembers area, including the website, the content made available inside it and any related services (together, the “Service”). Please read them carefully.

1. Acceptance of These Terms

By purchasing The Lost Prayer, creating or signing in to an account, or otherwise accessing the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old and able to enter into a binding contract to use the Service.

2. The Service

The Service is a private members area that gives you access to written and video content after a purchase completed through our online checkout. When your purchase is confirmed, we create an account for you and send your sign-in details to the e-mail address you used at checkout. All content included with your purchase is available from your first sign-in.

We may add, update, improve or remove parts of the content from time to time. We aim to keep the Service available at all times but do not guarantee uninterrupted access; the Service may be temporarily unavailable for maintenance, updates or reasons outside our control.

3. Account and Security

  • One account per purchaser. Your account is issued to the person who completed the purchase and is intended for that person only.
  • Keep your credentials private. You are responsible for keeping your e-mail address, password and any sign-in link confidential, and for all activity that happens under your account.
  • Accurate information. You agree to provide an accurate, working e-mail address at checkout, as it is the only way we can deliver your access and support you.
  • Tell us about problems. If you believe someone else has used your account, contact us at thelostprayer.support@gmail.com right away so we can reset your access.

4. License and Permitted Use

Subject to these Terms and to payment in full, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to access and view the content inside the Service, and to download any files we make available for download, solely for your own personal, non-commercial use.

You may print or save a copy of downloadable materials for your personal reference. All other rights are reserved. This license does not give you ownership of the content or of any copy of it.

5. Prohibited Use

You agree that you will not, and will not allow anyone else to:

  1. share, lend, sell or otherwise give your sign-in credentials to another person, or let another person use your account;
  2. copy, reproduce, redistribute, publish, upload, post, transmit, sell, rent, license or otherwise make the content (including any PDF or video) available to third parties, whether for free or for payment;
  3. remove, hide or alter any copyright notice, watermark or other identifying mark from the content — please note that downloadable PDFs are watermarked with the e-mail address of the purchaser, so copies that leave your possession can be traced back to your account;
  4. scrape, crawl, mirror or use automated tools to access, extract or download any part of the Service;
  5. reverse engineer, decompile, disassemble or attempt to derive the source code of the Service or to bypass any access control, watermarking or security measure;
  6. use the Service in any way that is unlawful, harmful, fraudulent, or that interferes with the operation or security of the Service or with other members’ use of it.

A breach of this section is a material breach of these Terms and may result in immediate suspension or termination of your account without refund, in addition to any other remedy available to us.

6. Purchases, Billing and Refunds

Purchases are sold by Nexa Digital LTDA (CNPJ 57.542.168/0001-46), Rua Antonio Basil Schroeder, 37, Barreiros, São José, SC, 88110-400, Brazil. Payments are made through our online checkout, operated by KashPay, and processed by Stripe. Prices are in US dollars; if your card uses another currency, your bank converts the amount and may add its own fees. We do not store your full payment card details. Charges appear on your card statement as “THE LOST PRAYER”.

Recurring billing. The Lost Prayer and its add-ons are billed as monthly subscriptions: each item you buy is charged again every month, at the price you paid for it, until you cancel. You can cancel at any time by replying to any of our e-mails or writing to thelostprayer.support@gmail.com; cancelling stops all future charges and does not remove the content you already have access to.

If you have a question about a charge or would like to request a refund, please contact us first at thelostprayer.support@gmail.com so we can help. Refund requests are reviewed individually and honored under the money-back guarantee shown on the offer page at the time of your purchase. Approved refunds go back to the card you paid with. Where a payment is refunded, reversed, disputed or charged back, your access to the Service may end.

7. Intellectual Property

The Service and all content inside it — including text, prayers, guides, videos, audio, images, graphics, layouts, names, logos and software — are owned by Nexa Digital LTDA (CNPJ 57.542.168/0001-46) or its licensors and are protected by copyright, trademark and other intellectual-property laws of the United States and other countries. Except for the limited license in Section 4, nothing in these Terms transfers any right, title or interest in the Service or its content to you.

8. Disclaimers

The content is provided for personal, spiritual and informational purposes only. It is not medical, health, financial, legal, psychological or other professional advice, and it is not a substitute for care from a qualified professional. Always seek the advice of a qualified physician, therapist, financial adviser, lawyer or other professional with any question you may have, and never disregard or delay seeking professional advice because of something you read or watched inside the Service.

We make no promise or guarantee of any particular outcome, result, benefit or experience from using the content. Individual experiences vary.

To the fullest extent permitted by law, the Service and its content are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be error-free, secure or uninterrupted, or that any defect will be corrected.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Nexa Digital LTDA (CNPJ 57.542.168/0001-46), its owners, officers, employees, contractors and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

In all cases, our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid for The Lost Prayer in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if your payment is refunded, reversed or charged back, if we are required to do so by law, or if we discontinue the Service. On termination, your right to access the Service ends immediately. Sections that by their nature should survive termination (including Sections 5, 7, 8, 9, 12 and 13) will survive.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the “Last updated” date above. If a change is material, we will make reasonable efforts to notify you, for example by e-mail or by a notice inside the Service. Your continued use of the Service after the revised Terms take effect means you accept them.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Brazil, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Brazil, and you consent to the personal jurisdiction of those courts. Before starting any formal proceeding, you agree to first contact us at thelostprayer.support@gmail.com and to make a good-faith effort to resolve the dispute informally for at least thirty (30) days.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
